Wilson Department of Agricultural Economics and Rural Sociology The index was compiled from a file of orders and other records kept at the office of the Alabama Milk Control Board, Montgomery, Alabama. At least one copy of each order issued after March 22, 1939, is maintained in the files of the Milk Control Board. A partial file of orders is kept by the Department of Agricultural Economics and Rural Sociology, Auburn Univer- sity,. Agricultural Experiment Station. Milk Control Law The Alabama Milk Control Board is constituted under the authority of :Ti.tle 22, Sections 205-231, Code of Alabama, as ammended. This law makes a. statement of policy of the State to promote, foster, and encourage the intelligent production and orderly marketing of commodities necessary to -its.citizens, including milk. The law states that unless producers, distri- :butors, and others engaged in.marketing milk are guaranteed a reasonable profit on milk, supply and quality of milk are affected to the detriment of ..the best interests of the public. The Milk Control Board was empower- ed with the authority to adopt and enforce rules and orders to carry out provisions of the Act. The Milk Control Board is vested with the power toq supervise and reg- ulate the fluid milk industry of the State including the production, trans- portation, manufacturing,, storage, distribution, deliyery, processing, and sale of milk. The Board requires the distributor or processor to pay for milk at the legal price.. . Based on records of the 'Alabama Milk Control Board. The latest ammendment to the Milk Control Law was signed into law on August 19, 1965 and becomes effective on February 1, 1967. The main provision of the new act is to change the organization of the Board from five members to six members, appointed for staggered 4-year terms. The present law provided for one consumer member, one public-at-large member, one producer member, one producer-distributor member, and one distributor member. After February 1, 1967, the Board will be composed of six members- two distributor members, two producer members and two consumer members. The Commissioner of Agriculture and Industry serves as an ex-officio member. An Executive Secretary has charge of the administration of the Board's orders, rules, and regulations. Licenses are required for all producers, producer-distributors, stores, milk dealers, distributors, bob-tailers (vendors), and cooling stations doing business in the State. Licensees must file reports of certain opera- tions deemed necessary by the Board. The Board has rights of entry, in- spection, and investigation for the purpose of ascertaining necessary information. A major provision of the Law gives the Board power to fix prices. Public hearings are conducted by the Board in the various milksheds to determine reasonable costs and charges for producing, hauling, bottling, packing, distributing, processing, and marketing milk, and for other services performed in respect to milk. The Board may establish the fol- lowing prices based on data presented at the hearings: 1. Minimum prices within each milkshed to be paid by milk dealers, producers, distributors, and producer-distributors to producers and others for milk in its various grades and uses. 2. Minimum or maximum prices or both to be charged within each milk- shed for milk sold at wholesale or retail for fluid consumption. The 3 minimum wholesale or retail price: or prices to be charged shall not be fixed higher than is reasonably necessary to cover the cost of ordinarily effici- ent and economic production, cooling, pasteurizing, distributing, ard marketing of such milk, which shall include a reasonablereturn and profit upon labor and necessary investment. 3. Charges to be allowed for handling, cooling, processing, storing, and distributing milk in any :transaction among producers, dealers, and distributors. Before revising or amending any order fixing the price or handling charges for milk, the Milk Control Board must hold hearings. The Board has the power to make and promulgate reasonable rules and regulations covering fair trade 'practices as they pertain to transaction of business among licensees. Some practices listed by the Act as unfair are: business among licensees. Some p false or misleading advertising; misrepresenting the quality of products, services, or other acts tending to defraud;'and giving prizes in connection with or making a lottery of the sale of milk. The Board may prevent any act by licensees intended to amke the provisions of this Act"inoperative. Distributors, cooperative associations, and bob-tailers pay a' license fee of 1 cent for each 100 pounds of 'milk and controlled milk products processed and sold in Alabama. Producers pay a license fee of 1 cent for each 100 pounds of milk produced for sale in the State. Producer-distributo pay as both a producer and a distributor. When the total amount collected in the fiscal year from license fees equals the budgetary requirements plus an additional sum of $25,000, the I cent per hundredweight fee is abated for the remainder of the fiscal year. The law specifically states that there shall be no discrimination shown against cooperative corporations or members of cooperatives. Non- observance of the 'inesing prvisios 'is a mi:sdemenor. Milk Control in Alabama Prior to 1939 The first Order in this index is Official Order Number 1, enacted March 22, 1939. However, the Milk Board that convened in 1939 was not the original Board. The first State Milk Control Board convened August 21, 1935, acting under the authority contained in Section 7 of the Hamner Milk Control Law, approved July 9, 1935. Orders of this original Board are not included in the index, as a complete file was not maintained. Scattered records available, however, show that this Board met, established rules of procedure, held hearings, established several milksheds, and issued many Official Orders. For example, Official Orders 40 and 41, which were violation orders, were issued April 8, 1936. These orders enjoined two licensee distributors from selling milk below the lawful price set by the Board. Official Order Number 60 set retail prices in the Birm- ingham shed September 25, 1936. Official Order 67 approved a bottle deposit for the Tuscaloosa shed, effective july 16, 1937. Thus, it can be assumed that actions of the earlier Boards were similar to those of subsequent Boards, which were constituted under the authority of a different State Law. Milk Control in Alabama Since 1939 Although Alabama has had State Milk Control since the 1930's, it has been only in recent years that authority of the Board has been expanded to cover all the State. Until the early 1950's, regulated areas were defined as relatively small milksheds. Each shed was usually defined as a designated municipality and the nearby area. Figure 1 shows areas under State regula- tion in June 1952. Because of changing marketing conditions, the Milk Control Board expanded regulated market areas, generally' along county lines. The three milksheds as they are currently designated are shown in Figure 2. Description of the Index The index is presented as a reference guide to the Official Orders issued by the Alabama Milk Control Board. Because of different numbering systems used by the various Boards through the years, orders are listed chronologically, by date issued, rather than in numerical order. Orders are listed left to right in the following manner: Date Ordered, a brief de- scription of the matter dealt with, and date the order went into effect. In the case of orders dealing with alleged violations of the Board's regulations, the names of the parties involved have been omitted. However, a brief de- scription of the violation and the penalty, if any, has been included when possible. Orders marked with an asterik (*) denote orders in effect on January 1, 1966. The Milk Control Board has three commonly used outlets for disseminating its rules, regulations, and decisions. These are Orders, Rules of Fair Trade Practices, and Notices to the Industry. The Rules of Fair Trade Practices in effect on January 1, 1966 are listed following the index of orders. A brief rsumb of the subject matter of each rule is given. Notices to the Industry commonly deal with such matters as inter- pretation of orders and notices of court decisions or injunctions.
